Terms of Service

These Terms of Service (“Terms”) govern access to and use of Jaza (https://jaza.dev), including the website, APIs, dashboards, and SDKs, operated by Polele SAS (“Polele”, “we”, “us”), Kinshasa, Democratic Republic of the Congo. By using Jaza, you agree to these Terms.
These Terms are a practical draft for early access and are not a substitute for legal advice. Mandatory consumer protections in your country of residence (including the EU) remain unaffected where they cannot be waived.
1. The service
Jaza provides prepaid / metered billing infrastructure for applications, including credit wallets, feature metering, Mobile Money and card top-ups via payment partners, developer APIs, and a dashboard. Features may change during early access.
2. Eligibility and accounts
You must be able to form a binding contract and use the service for lawful business or development purposes. You are responsible for safeguarding API keys, credentials, and account access. Notify us promptly of unauthorized use.
3. Acceptable use
You agree not to:
- Violate applicable law, including payments, AML, sanctions, or privacy rules
- Abuse, disrupt, or reverse-engineer the service except as allowed by law
- Use the service for fraud, illegal gambling, or prohibited content
- Resell or misrepresent the service without our written permission
- Circumvent rate limits, security, or sandbox/live environment controls
We may suspend or terminate access for violations or risk to the platform.
4. API keys, environments, and your apps
You may receive test and live credentials. You are responsible for configuring payment methods, features, bundles, and webhooks correctly. You remain responsible for your application’s relationship with your end users, including your own privacy notices and terms.
5. Payments, fees, and settlements
Top-ups and settlements may involve third-party payment providers (e.g. PawaPay, Stripe). Provider fees, FX, and settlement timing are subject to those providers’ terms and network rules. Jaza platform fees, if any, will be disclosed in the dashboard or a separate order form. Balances and ledger entries are tools to operate prepaid billing; they are not a bank account or regulated deposit product unless we expressly state otherwise under applicable licensing.
6. Intellectual property
We and our licensors own Jaza, including software, branding, and documentation. You receive a limited, non-exclusive, non-transferable license to use the service as provided. You retain ownership of your application code and content you submit, and grant us a license to host and process it as needed to provide the service.
7. Privacy
Personal data is handled as described in our Privacy Policy and Cookie Policy.
8. Disclaimers
The service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Early access features may be incomplete or change without notice.
9. Limitation of liability
To the maximum extent permitted by law, Polele SASand its directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the service will not exceed the greater of (a) fees you paid us for the service in the three (3) months before the claim or (b) one hundred US dollars (USD 100), except where liability cannot be limited (e.g. death or personal injury caused by negligence, or fraud).
10. Indemnity
You will defend and indemnify Polele SAS against claims arising from your application, your end users, your misuse of the service, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
11. Governing law and disputes
These Terms are governed by the laws of the Democratic Republic of the Congo, without regard to conflict-of-law rules. Courts located in Kinshasa shall have jurisdiction, subject to mandatory rights of consumers in the European Union or other jurisdictions that cannot be waived by contract.
12. Changes
We may update these Terms by posting a revised version on the site. Continued use after the effective date constitutes acceptance, except where additional consent is required by law.
